1. Services
OptimityFX provides creative services including video editing, color grading, graphic design, AI-generated content, education (NextGen Academy) and business coaching. Project scope, deliverables and timelines are defined in your individual agreement or order.
2. Payments & Invoicing
Project work typically requires an advance to commence, with the balance due before final delivery. Digital products and courses are charged in full at checkout. All prices are exclusive of applicable taxes unless stated.
3. Revisions
Each engagement includes a defined number of revision rounds. Additional revisions or scope changes may incur extra charges, communicated before work proceeds.
4. Refunds
Service deposits are non-refundable once work has begun. Digital products (LUTs, presets, templates, courses) are non-refundable after download due to their nature. See specific offer terms at checkout.
5. Intellectual Property
Upon full payment, final deliverables are licensed or assigned to you as specified in your agreement. OptimityFX retains the right to showcase completed work in its portfolio and marketing unless a written NDA states otherwise. Digital products are licensed for your use and may not be resold or redistributed.
6. Client Responsibilities
You are responsible for providing source files, timely feedback and any rights/clearances for materials you supply (footage, music, logos). You warrant that supplied content does not infringe third-party rights.
7. AI-Generated Content
AI-assisted deliverables are produced using third-party tools. While we strive for originality and quality, you are responsible for final review and compliance with platform and advertising policies in your jurisdiction.
8. Acceptable Use
You agree not to misuse our website, attempt unauthorized access, or use our services for unlawful, infringing or harmful purposes.
9. Limitation of Liability
To the maximum extent permitted by law, OptimityFX's total liability for any claim is limited to the amount paid for the specific service or product giving rise to the claim. We are not liable for indirect or consequential damages.
10. Changes to These Terms
We may update these Terms from time to time. Continued use of our services after changes constitutes acceptance of the revised Terms.
11. Governing Law
These Terms are governed by the laws of India, and disputes are subject to the exclusive jurisdiction of the courts located in our registered place of business.
